In an insolvency situation, employees may transfer under the Transfer of Undertakings (Protection of Employment) Regulations 2006 (TUPE) to a new employer where the business is sold. In the alternative, employees may find themselves at risk of redundancy.

Our Employment Lawyers can advise employers on the implications of TUPE or on the redundancy process and ensure that they fulfil their obligations to inform and consult and that any dismissals are fair.

As an employee, you may be unable to recover money due from your employer under statute or your contract of employment, such as unpaid wages or notice pay, statutory redundancy payment and/or award for failure to inform and consult. If an insolvent employer fails to pay all or part of a payment to an employee, the employee may apply for the payment to be paid out of the National Insurance Fund.

Our Employment Lawyers can help employees find out what they are entitled to and how to recover any outstanding sums.
