Our Coroner’s Inquests expertise
Inquest proceedings are inquisitorial, not adversarial, and therefore, there is no resulting acquittal or conviction; it is a finding of fact rather than a placing of blame. We work to represent and protect our client’s interests while simultaneously assisting the Coroner in reaching a conclusion at the end of an inquest to establish who, when, where and how the deceased came by their death.
Our expert legal team provide sound advice and representation at every stage of the proceedings in accordance with our client’s instructions and best interests.
Acting for a company
When representing a company at an inquest, such interested parties are usually joined as a participant to the proceedings because the death occurred on their business premises and/or whilst they were under the company’s care or employ. These companies may be legal entities such as a care home, a construction company, a hospital, a transport company, a factory, or a working farm – to name but a few.
There will invariably be a heightened concern that the Coroner’s findings may result in subsequent criminal proceedings relating to the company’s liability following the conclusion of the inquest. The consequences of such prosecutions can potentially devastate a company’s reputation and financial position if (for instance) the company is found to have been in serious breach of health and safety regulations, which demonstrably contributed to the death. It is imperative that rigorous legal representation is therefore employed to protect and support the company’s position in the proceedings whilst simultaneously assisting the Coroner in requisite inquest investigations.
