£65,000 settlement for Suffolk man whose Lisfranc injury went undiagnosed
Julie Crossley, a medical negligence lawyer at Ashtons Legal, has obtained £65,000 for Mr H who was given an incorrect diagnosis for an injury to his foot following a fall.
Mr H went to his local Accident & Emergency Department in Ipswich after suffering a painful, bruised and swollen foot. The triage nurse suggested it was a ligament injury so he didn’t wait to be x-rayed.
When the foot had not healed a few weeks later, Mr H went to see his GP and was subsequently x-rayed and told there was not any significant abnormality. It was not until the following year when he had still not recovered, that he was referred to a podiatrist. The eventual outcome was that Mr H had suffered a Lisfranc injury and was required to spend almost a year in a plaster cast to correct the injury but still suffers some secondary symptoms.
Julie comments: “All too often when people come to see us for legal advice it is because they have received the wrong information or treatment in the early stages of an illness or injury and this has had a serious impact on the long-term outcome. Sadly, the NHS is not currently sufficiently well funded or resourced to enable these sorts of mistakes to be eliminated entirely although there are many committed professionals doing their best to reduce the incidence of this type of human error.”
