Five figure settlement for asbestos claim
Martyn Hayward, a specialist asbestos-related disease lawyer, has obtained a five-figure settlement for the family of a deceased lady who suffered from mesothelioma, an asbestos-related illness.
Mrs G was employed as a domestic cleaner at the old Norwich & Norfolk Hospital, St Stephen’s Road, from around 1986 to 2002. She advised she was exposed to asbestos when she cleaned the underground service corridor at the old hospital which has now been demolished.
Mrs G instructed her legal team at Ashtons Legal that the service corridor had asbestos lagged pipes at ceiling level. Martyn argued that the asbestos insulation on the pipework was in poor condition but the defendant Trust maintained it was well managed. Mrs G was never warned of the dangers of asbestos, neither was she provided with any respiratory protection by the Trust’s management.
Sadly, she died before her case could be concluded.
After a protracted legal battle, the Trust’s offer of settlement was accepted by the family in December 2019, just before Christmas and days before the three day trial at the Royal Courts of Justice, London was scheduled to start.
