Over £10,000 settlement obtained for lorry driver injured in a traffic collision
Ben Nicholls, a personal injury specialist at Ashtons Legal, has obtained a damages award of over £7,000, and around a further £3,000 in costs (which was ordered by the Judge as a consequence of the defendant insurer’s approach to negotiation), for a lorry driver in his 40s who was injured when his vehicle was hit from behind by another lorry in North Yorkshire.
Over a year after the incident, Mr T is still unable to return to his job as a driver and has had to take an office-based job instead. He continues to suffer various symptoms including neck and back pain and headaches and requires ongoing medication.
Ben comments: “This was a classic instance of a defendant insurer refusing to acknowledge the true value of the claim and make a sensible settlement in the early stages but then having to pay that higher amount, plus additional costs, a little over six months later. It was very satisfying to be able to obtain a fair settlement for Mr T but nevertheless frustrating to have to take the matter to trial in order to get the right result.”
