Over £180,000 obtained for injured pedestrian

Siobhan McWhinney, a personal injury specialist at Ashtons, has obtained over £180,000 for Mr X, an elderly Cambridgeshire man who suffered brain, pelvis, arm and leg injuries when hit by a car as he was crossing a road.
Siobhan comments: “This case was frustrating in some respects because the defendant insurers continued to deny liability for around three years before agreeing to settle the claim. The main reason behind this was that Mr X was wearing dark clothing when crossing the road on a winter’s evening and was not able to cross at a pedestrian crossing; this combination made him quite difficult for a motorist to see. However, it was clear that the car driver was going too fast for the circumstances which is why she failed to stop and collided with Mr X, badly injuring him.
What this does show is that even when an injured person believes that they may have to accept some responsibility for the injuries they have suffered, it is still worth pursuing a claim. This is particularly the case where the injuries are severe and high levels of future care will be needed.”
