Lasting Powers of Attorney – Make your own choice

  • Posted

We are an aging population but, unfortunately, long life does not always mean we retain the mental or physical capacity, or simply the energy, to manage our financial and personal affairs until the end.

We can cover this possibility by making a Lasting Power of Attorney (‘LPA’). There are two types of LPA, Property & Financial Affairs LPA and Health & Welfare LPA.

A Property and Financial Affairs LPA appoints an attorney to manage our financial and property affairs.

A Health & Welfare LPA appoints an attorney to make decisions relating to our health care, welfare and medical decisions, including giving power to give or refuse consent to life sustaining treatment.

If we do not make an LPA, and become incapable of managing our affairs and making our own decisions, a third party can apply to the Court to be appointed as a Deputy to act on our behalf.  This is a much more time consuming and usually more costly process and does not allow us to make a choice for ourselves as to whom we wish to deal with our affairs and make those decisions.

For a fixed sum, we can appoint whom we know and trust to make decisions on our behalf.

Costs for LPAs start at £600 + VAT for a single LPA for one person.
