Family obtain a four figure settlement from BUPA Care Homes Limited following lack of care

Ben Ward, a clinical negligence specialist at Ashtons Legal, has obtained settlement for the family of Mr W, who died on 10th February 2012. Numerous failings in the quality of care provided to Mr W resulted in him suffering from a black eye, a carpet burn, a fractured hip, sepsis and a deterioration of his dementia. All allegations were denied by the care home.
Mr W suffered from vascular dementia and became a full-time resident of the Nursing Home on 26th June 2009. During his time at the Nursing Home Mr W gradually lost the ability to stand and was unable to communicate effectively. He relied on staff for all his care needs and sustained serious injuries whilst in their care. The Nursing Home also failed to comply with BUPA reporting procedures and failed to complete accident reports on various occasions. An investigation was undertaken by Hampshire County Council with regards to the quality of care at the Nursing Home and recommendations were made.
Ben comments: “Those most vulnerable in our society rely on institutions like care homes to ensure that they are properly cared for and protected. Safeguarding residents is a crucial factor in ensuring avoidable injuries are not sustained. Whilst a full denial of liability was made on behalf of BUPA the records kept on behalf of Mr W was, in my opinion, to a poor quality. The family raised their concerns on a number of occasions and were left frustrated with their perception that those concerns were seemingly not taken onboard. The final few months of Mr W’s life, and the deterioration that he suffered, was truly tragic and I hope that BUPA has now put in place safety measures to ensure that further residents do not suffer avoidable injuries whilst under their care”.
