Ashtons Legal obtains £12,400 at trial for hernia sufferer

Tim Gleave, a personal injury specialist at Ashtons Legal, was sufficiently determined to obtain justice for his client, Mr D, that he pursued his personal injury claim to court even though in financial terms the claim was of modest value. The District Judge at Bury St Edmunds County Court shared Ashtons Legal’s view that the insurers needed to compensate Mr D for his injuries.Mr D had been working as a civilian at a local RAF base. A heavy vice fell from a cabinet in the workshop and in trying to stop it falling on his foot, Mr D suffered a hernia. The cabinet was later found to be unsuitable.Tim comments: “It shouldn’t be necessary to take claims of this value to trial in order to get justice for our clients. Our fear is that if insurance companies start to fight smaller claims rather than settle them sensibly, there will be more clients who don’t get the compensation they need and deserve when they are injured in an accident. Unfortunately not all personal injury lawyers take the Ashtons Legal approach to fighting the client’s corner if insurers prove awkward.”
