Ashtons Legal helps to guarantee the future care of Norwich girl who suffers from cerebral palsy

The Courts have today approved a settlement which will enable the Dye family from Easton in Norwich to ensure that their daughter Emily has the care she needs for the rest of her life. Emily, 10, was born at the Norfolk & Norwich Hospital but, due to a series of errors in her mother’s treatment during her labour, suffered a severe brain injury.

The family’s lawyer is Tom Cook, a medical negligence specialist at Ashtons Legal. He explains:“Emily was deprived of oxygen during the last few minutes of her mother’s labour, and was not revived effectively immediately after her birth, a situation which could and should have been avoided. As a result she suffers from cerebral palsy which affects her entire body, meaning that she will need full-time care for the rest of her life.

We have obtained a settlement which is likely to amount to in excess of £4 million over her lifetime. The majority of this will be paid on an annual basis to compensate for the fact that as an adult Emily will be unable to earn her own living and will still require others to care for her.”

Emily’s mother, Joanne, says: “Every parent whose child suffers a brain injury must have similar concerns – how do we get the best possible treatment to maximise their quality of life and who will look after them if there comes a time when we are no longer able to do so? We are pleased and relieved that we can now be sure that there will be sufficient funds to pay for Emily’s continuing therapies and care.”
