£4.9 million obtained for birth injury resulting in cerebral palsy

Tom Cook, a consultant solicitor within the medical negligence team at Ashtons Legal, has obtained £4.9 million for the family of a baby who was left with severe brain damage following negligent hospital care.

Baby J was born with signs of a hypoglycaemic/hyperinsulinaemic injury (a condition in which there are excess levels of insulin circulating in the blood relative to the level of glucose). During the first 48 hours of the infant’s life, the hospital failed to monitor his condition, and did not listen to the mother’s concerns about Baby J’s loss of interaction and interest in feeding.

On the baby’s third day of life, his blood sugar level dropped, sending him into hypoglycaemic shock and cardiac arrest which subsequently left the child with permanent brain damage and cerebral palsy. He now requires 24 hour care and will need it for the rest of his life.

Baby J’s mother approached Ashtons several years ago in search for answers. After years of making sure that no stone was left unturned, Tom has obtained a lump sum settlement of £1.975 million plus annually increasing periodical payments starting at £125k for the child’s family. These will continue for the lifetime of the child.
