Six-figure sum obtained for family of mesothelioma sufferer
Martyn Hayward, an Ashtons Legal asbestos-related disease claim specialist, has obtained a six-figure settlement for the family of Mrs A, a woman who died in 2019 after a battle with mesothelioma.
Mrs A developed mesothelioma after being exposed to asbestos when she worked as a nurse at the High Wycombe Hospital from the mid-1970s through to 2003. Her husband had also worked as a fitter at the hospital and Mrs A was also exposed to asbestos by washing his contaminated overalls.
Both the employers’ liability claim against the hospital trust and the secondary exposure case were brought in tandem by Mrs A’s family. The Trust admitted liability, although sadly not until after Mrs A’s death, and a financial settlement was reached a month before the case was due to go to court.
Martyn comments: “It is often the case that mesothelioma sufferers have been exposed to asbestos in more than one way. Most frequently it is tradesmen such as carpenters, electricians or pipefitters who have been exposed repeatedly over a number of years while working for a different employer. Secondary exposure is, however, one of the most common causes of mesothelioma in women. Whatever the circumstances, so long as we can show definite exposure to asbestos which was not the fault of the mesothelioma sufferer we have the starting point for bringing a claim.”
