£100,000 settlement for woman who suffered faulty eye surgery

Medical negligence claim specialist, Julie Crossley, has obtained a six figure compensation settlement for an elderly lady who was rendered almost blind by faulty eye surgery.

Ms C suffered from age-related macular degeneration and had lost almost all of the vision in one eye. She relied on the other eye to remain independent.

Ms C answered an advert in a newspaper for a revolutionary new implant suggesting sight could be restored. She attended a consultation in Harley Street and was advised that there was no risk and she was a suitable candidate. She paid £25,000 for both eyes and a further £3,000 for laser treatment, and it was agreed to treat the worse affected eye first so that if the implant failed, she would continue to remain independent with the vision in the better eye.

Her treatment did not go to plan. On arrival for surgery she was only offered the option to treat the better eye. Although this was unexpected she did agree to go ahead. Following the implant Ms C suffered pain and high interocular pressure, which was not treated appropriately, with the eventual result that Ms C developed glaucoma in that eye, leaving her virtually blind.

Julie comments: “The experts agreed that she would have lost central vision in both eyes within five years due to the macular degeneration and therefore eventually needed care in any event. However, she should not have incurred the pain and suffered caused by the operation or the premature total loss of sight. Money can never take the place of sight but the settlement will make it easier for Ms C to pay for the care she now needs.”
