Ashtons successful in obtaining damages payment following missed scaphoid fracture

Ashtons Legal was instructed in January 2023 on behalf of JD, who had suffered a non-dominant wrist injury, which was missed on X-ray and follow-up by his local Hospital Trust.

The injury caused ongoing issues and was eventually identified six months later after referral by his GP for a further X-ray.

The delay in diagnosis of the scaphoid fracture meant that the fracture had not healed properly, and JD required open reduction and internal fixation (ORIF) surgery to his wrist, which took place in November 2022, over 14 months from the original injury.

A formal civil claim was brought against the Hospital Trust with the support of expert evidence from an A&E surgeon and consultant orthopaedic surgeon. Full admissions were made by the Trust, and the Claimant’s Part 36 offer of £13,500 was accepted.
