£200,000 obtained for a seriously injured gym-user
Louise Harper, a personal injury specialist at Ashtons Legal, has obtained a settlement of £200,000 for Ms M, a Norwich woman who was injured while exercising at a fitness centre.
Ms M was injured when another gym user unloaded the weights on a barbell incorrectly, resulting in the bar flipping up and striking Ms M, who was exercising nearby, on the back of her head.
Ms M suffered a mild traumatic brain injury as well as external physical injuries. In addition to scarring from the external issue injuries, Ms M is left with a range of long-term symptoms as a result of her injuries. These include suffering regular headaches, difficulties with memory and concentration, anxiety, tiredness and lethargy. She has also lost her sense of smell and taste.
Louise comments: “What should have been a safe exercise environment proved not to be and Ms M is left dealing with a range of life-affecting symptoms. The onus is on gyms and fitness centres to ensure that they take all appropriate steps to protect their users, including ensuring that everyone using the equipment has access to clear guidance on how to use it safely. The way in which the equipment in a gym is laid out to minimise the chances of an incident of this sort is also important. It is hoped that lessons have been learnt from this incident and no one else will suffer similar injuries in the future.”
