£2.7m injury settlement obtained by Personal Injury Solicitor, Richard Foyster, for Suffolk pedestrian who was hit by a car.
Richard Foyster, who heads the Personal Injury team at Ashtons Legal, has obtained an injury settlement of £2.7 million for a Suffolk boy who was hit by a vehicle and suffered severe head injuries and damage to the frontal lobe of his brain. Master X ran across the road after getting off a bus and was hit by a car which was unable to stop in time. Master X now suffers from a moderately severe dysexecutive syndrome, meaning that he has a brain injury which has a range of cognitive, behavioural and emotional symptoms which tend to occur together. His ability to make sensible judgments for himself has been affected.
Richard comments: “This settlement will help to make life considerably easier for Master X and his family as he goes into adulthood, including enabling him to move into his own home rather than living permanently with his parents. Although his earning potential will never be high and he will always need support on various levels, he is carrying on with vocationally based education. The injury settlement awarded was 60% of the full value of the claim because the courts took the view that running out behind the bus without looking should result in a 40% deduction for contributory negligence”.
