£100,000 obtained for Hand Arm Vibration Syndrome (HAVS) sufferer
Richard Foyster, a personal injury specialist at Ashtons Legal, has obtained a substantial settlement for a Suffolk man in respect of his HAVS and carpal tunnel injuries.
These were incurred in the course of his job which required him to use sanders, drills, polishers and grinders on an almost daily basis. Sadly he had not been given any training about the potential damage of prolonged use of vibrating tools, nor were any risk assessments undertaken. By the time Occupational Health became involved his symptoms were quite severe and the damage was done. Mr H has ongoing problems with his hands and has had to change his job.
Richard comments: “The cause of Mr H’s injuries was very clear and it is disappointing that his employers’ insurers took so long to accept liability. While money will not make up for the pain he has suffered, it will help to ensure that he is not out of pocket by having to change his employment mid-way through his working life.”
