Ashtons success in Court of Appeal case
Polly Stephenson has achieved a successful outcome in the Court of Appeal case of Bowser v Smith in which the appellant solicitor appealed a costs order in a hostile action to remove a widow as executor of her late husband’s Will.
This emphasises the importance of litigation being used only as a last resort that it is crucial to act in the best interests of an estate (and not to unreasonably delay), and the fundamental issue of ‘conflict of interest’ in litigation.
